Draft notice: this page was prepared with AI assistance as a first, good-faith draft based on how the service actually works. It has not yet been reviewed by a licensed attorney. Have it reviewed before relying on it at scale.

1. Who we are

Don't Get Towed! ("we," "us," the "Service") is operated by Don't Get Towed, Inc., a New York corporation. You can reach us at contact@dontgettowednyc.com.

2. What the Service does

We monitor New York City's public parking and camera violation records (from NYC Open Data) for vehicles you add, and notify you by email, text message, and/or your dashboard about new violations, your boot/tow risk, and dispute deadlines. Some features are free; some are paid, described below.

The Service also offers, for a separate fee:

  • Fleet billing for business accounts managing multiple vehicles, billed per vehicle per month, adjusting automatically as vehicles are added or removed.
  • Dispute drafting assistance -- for a flat fee, we use an AI model to help draft a written statement disputing a ticket, based on the ticket's own public facts and your own explanation. This is drafting help only. We do not file anything on your behalf, do not guarantee any outcome, and you are responsible for reviewing and submitting the statement yourself through NYC's own official dispute process.
  • Ticket payment facilitation -- we can direct you to NYC's own official payment system (CityPay) to pay a violation with your own card. We never take custody of your ticket payment; the City is paid directly by you. We separately charge our own convenience fee (currently 5% of the ticket amount, or $2, whichever is greater) for this facilitation, refundable under the conditions in Section 4.

3. Eligibility and your account

You must be at least 18 years old and able to form a binding contract to use the Service. When you sign in, we create an account tied to your email address.

Adding a vehicle: when you add a vehicle, you confirm that you own it or are authorized by its owner to manage it and receive information about it. We do not require you to upload a registration or other ownership document -- we rely on this confirmation. NYC violation data tied to a public license plate is itself public information; however, providing a false confirmation, or adding a vehicle you have no right to manage, is a violation of these Terms and may result in your account being suspended or terminated.

Personal and business accounts: personal accounts are free and are for vehicles registered to you as an individual and used mainly for personal purposes, up to two vehicles at a time. You may change one vehicle per rolling 12-month period (adding a different vehicle, or bringing back one you removed more than 24 hours earlier). If you need to track more vehicles, contact us. Vehicles registered to a corporation, LLC, partnership or other business, or used mainly for business, must be tracked under a business account (see Section 4). When you add a vehicle to a personal account, you confirm it meets this description.

Ownership verification: you authorize Don't Get Towed, Inc. to verify the registration and ownership of any vehicle you add, including by requesting registration records where the law allows.

Reclassification: if we find that a vehicle on a personal account is registered to a business or used mainly for business, we may move it to a business account and its pricing, or remove it from your account. We'll tell you by email before any business-plan charge begins.

4. Fees, billing, and refunds

Free-tier features (violation tracking, boot/tow risk alerts, and the dispute-deadline countdown) are free for personal accounts, within the vehicle limits in Section 3.

Business (fleet) billing is a recurring monthly charge, currently $5 per tracked vehicle, billed automatically and adjusted immediately as vehicles are added or removed. If a monthly charge fails, we will retry it once a day; if it remains unpaid after five retries, tracking and alerts are paused (your data is kept) until payment succeeds.

Dispute drafting is a one-time, pay-per-use fee (currently $5) charged when you request a draft. It is non-refundable once the draft has been generated, except at our discretion.

Ticket payment convenience fee: we charge this fee at the time you complete the CityPay redirect flow. If, after three weeks, our own check of NYC's public records still shows the underlying ticket unpaid, we will automatically refund this fee. If you contact us before then with evidence the city-side payment clearly failed, we will refund it sooner. This fee is separate from, and does not include, the ticket amount itself, which is paid directly to the City through CityPay.

All payments are processed by Stripe. We do not store your full card number.

5. Data accuracy and no guarantee of outcome

We source violation data directly from NYC's own public Open Data feed. That feed can be delayed, incomplete, or occasionally inaccurate, and we check it on a daily schedule -- not in real time. We do not guarantee that using the Service will prevent your vehicle from being booted or towed, that every violation will be caught or caught immediately, or that any dispute drafted with our assistance will succeed. The Service is an informational and organizational aid, not a substitute for checking your own vehicle's status directly with the City when it matters.

6. Not legal or financial advice

Nothing in the Service, including AI-drafted dispute statements, guide articles, or risk estimates, is legal, tax, or financial advice. For advice specific to your situation, consult a licensed professional.

7. Third-party services

The Service relies on third parties to operate, including Stripe (payments), Supabase (hosting and accounts), Resend (email delivery), Twilio (text messages), Anthropic (AI-assisted dispute drafting), and NYC's own Open Data and CityPay systems. We are not responsible for outages, errors, or policy changes on their part, though we'll do our best to keep the Service working around them.

8. Text message alerts

Program. Don't Get Towed! text alerts tell you when NYC's records show a new ticket on a vehicle you track, when a payment or dispute deadline is approaching, and when your unpaid balance nears the level at which NYC can boot or tow your vehicle. Texts are sent from our toll-free number, (866) 254-6093.

Opting in. Text alerts are optional and off by default. You opt in by entering your mobile number in your dashboard and ticking the consent box. Consent is not a condition of using the Service or of any purchase.

Frequency and cost. Message frequency varies with your tickets, usually a few messages per month. Message and data rates may apply, according to your mobile plan.

Opting out and help. Reply STOP to any text to stop receiving them; we'll send one message confirming you're unsubscribed. You can also turn text alerts off from your dashboard. Reply HELP for help, or contact us at contact@dontgettowednyc.com.

Delivery. Mobile carriers are not liable for delayed or undelivered messages. Text alerts supplement, and do not replace, email alerts and your own review of your tickets.

9. Acceptable use

You agree not to:

  • Add a vehicle you do not own and are not authorized to manage;
  • Use the Service to harass, stalk, or gather information about someone else's vehicle without authorization;
  • Attempt to scrape, reverse-engineer, or overload the Service or the data behind it;
  • Use the Service for any unlawful purpose.

10. Disclaimer of warranties; limitation of liability

The Service is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages -- including boot, tow, storage, or penalty costs -- arising from your use of, or inability to use, the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

11. Termination

You may stop using the Service and delete your account at any time by contacting us. We may suspend or terminate an account that violates these Terms, including a false ownership confirmation.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above. Continued use of the Service after a change means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
